2 year separation mandatory in mutual consent divorce for christians

14-May-2026 (In Divorce Law)
We are a Christian couple from Secunderabad. We lived together only 45 days, after which my wife left and never returned. We have been separated for 1 year and 4 months. During court mediation, both expressed disinterest in continuing the marriage. We signed an MoU settlement and I provided the DD as agreed. The petition is still in the administrative office, and counsels are discussing withdrawal/correction before filing mutual consent divorce under Section 10A. Can we file now or wait till Dec

Since you are Christians and have already completed more than one year of separation, and both parties have expressed unwillingness to continue the marriage during mediation, you are legally eligible to proceed with Mutual Consent Divorce under Section 10A, subject to proper procedural compliance. If the settlement terms, MoU and DD payment are already finalised, there is generally no legal necessity to wait till December merely for delay purposes. However, before filing: • Ensure withdrawal/correction of pending proceedings is properly drafted • Ensure settlement terms are comprehensive and legally enforceable • Ensure DD/payment acknowledgement is clearly recorded • Ensure there are no future claims left open regarding maintenance, dowry, articles or litigation Do not proceed casually with partial documentation. Once mutual consent terms are recorded before Court, they become binding and difficult to reopen later. If both sides are genuinely willing and all procedural corrections are completed, you may proceed immediately through proper legal drafting instead of unnecessarily prolonging the matter.

as per the information furnished by you, it's very clear that terms among you both parties settled and the permanent alimony is also been arranged. you can withdraw the petition if any is pending before the court immediately by filing an advance petition and on the same day you can file the mutual divorce petition.
