1st motion is done , I do not want to go for second one.

13-Dec-2023 (In Divorce Law)
My first sign was done on 29 September. I wasn't mentally ready for it but his family pressured me alot . I didn't know what to do at that time hence I signed. I don't want divorce from my husband and do not want to sign for the 2nd motion that is on 9th April 2024. I just want to know what effect it will have on me if I do not sign a second motion . Will I get a chance to save my marriage? They change the date as well to last year to get the divorce done early.

If you will not go on the second date then they will adjourn the matter and give another date. This process will go on for an year and if you still not appear then judge will dismiss the matter for non-appearance. Your husband may sue you under civil for non-performance of contract. If i will get to know what was the terms of the agreement you guys have signed then i will be able to provide better solution to your problem. feel free to call me

you have every right to save your marriage. Nobody can force you to give a second statement. If you don't want to give a second statement, then I will suggest you to move the application accordingly and even suggest you to file a petition under section 9 of Hindu Marriage act that you want to live with your spouse. You may have to return benefits received by you on the first statement.

first of all. you are not under obligation to sign your consent for second motion But The complications could arise where you signed the memorandum of Mutual divorce depending upon the clauses it has. Contempt proceedings could also be intiated by other party. Hence to move further I would advise you to go through the legal advice. I can give you that only after reading your case file. Feel free to contact me.
