Don't worry, aapki problem ke liye law me clear remedies hain. Wife ne galat address dala hai, isliye aap Order 9 Rule 7 CPC (agar case chal raha hai) ya Order 9 Rule 13 CPC (agar decision aa gaya hai) ke tehat court me application dekar ex-parte order ko cancel karwa sakte hain. Agar petition me alimony mangi gayi hai, toh court ex-parte me divorce aur alimony dono decide kar sakta hai. Iske liye aapko abhi direct High Court jaane ki zaroorat nahi hai, pehle usi Family Court me order cancel karwana hoga. Sahi legal action ke liye aap Advocate Sudesh ke saath ek consultation appointment book kar sakte hain.

aap jaldi vakeel karke court me appear ho jao aur court ko ye batao ki apko notice prapt nahi hui hai. agar aisa nahi karogi to apki absence me court apki patni ke favor me decision de sakti hai. isi liye aap jaldi se ek lawyer se sampark kare aur court hearing ko attend kariye.

, aap chinta mat kijiye iska upay hai. Aapki wife ne galat address par notice bhej kar ex-parte divorce ka case karwaya hai. Aise mein aap usi Family Court mein Order 9 Rule 13 CPC ke tahat ex-parte order ko set aside karne ke liye application de sakte hain. Agar time nikal gaya hai to uske saath Section 5 Limitation Act ki delay condone application bhi dena hoga. Aapko court mein sabit karna hoga ki notice aapko mila hi nahi hai. Dusra sawal, is 13(1)(1a) ke divorce case mein sirf divorce ka faisla hoga. Alimony ya maintenance is case mein decide nahi hogi. Uske liye wife ko alag se Section 25 HMA ya 125 CrPC ka case karna hota hai. Teesra, agar decision aapke against aata hai to aap High Court mein appeal kar sakte hain. Salah hai ki turant ek lawyer se mil kar file nikalwa kar set aside application file kijiye.

The fact that you were not properly served the notice and the court is proceeding ex-parte. It is essential for you to 1. File a petition to set aside the order to proceed ex-parte against you. 2. Provide proof of your actual address. Regarding alimony- it is common practice to decide divorce and financial matters like alimony together. A final decree could have serious, irreversible financial consequences for you.
