Can Downloading Copyrighted Material put me in jail

05-May-2023 (In Cyber Crime Law)
Does downloading copyrighted movies, music, games, books and Japanese Cartoons (Anime) without paying for it from torrent websites or any other websites enough to put you in jail? In the following links: https://timesofindia.indiatimes.com/city/mumbai/Viewing-pirated-films-online-not-an-offence-Bombay-HC/articleshow/54009022.cms https://www.livemint.com/Leisure/L7NjKAoe7L3MqXe6XpQ5FK/High-Court-says-viewing-pirated-films-isnt-illegal.html It's not made clear whether downloading and storing the pirated material (and it's just given about movies, nothing mentioned about music, games, books and anime) will put you in jail.

Till the time you are viewing the movies or listening the songs online, it’s not an offence. However, when you download it through torrents and store in your computer, it is a copyright violation as you’ve not legally purchase it.

All actions by an individual will not result in the complaint by the copyright owner. The test is generally whether the accused infringer is causing an irreparable injury and a substantial economic loss by distributing the copyrighted subject matter to masses, only then the copyright owner will take action. Although, law does not stop him to take an action against a single person too. In your case, the copyright owner will be more interested in running after the torrent website. However, there were cases outside India where courts have held liable individual users too. So play safe and do not promote piracy.
