Withdrawl of suit letter has not been given by plaintiff to defendant

Summons were issued for the recovery of debt and the said debt was paid off before time. Later the defendant did not appeared and now a warrant is issued because the petitioner did not withdraw the suit from the said court. What can be done now ?

You will have to appear in the court and inform the court about the same. Also, as a precaution you should file consent terms and get the matter disposed rather than asking for withdrawal. Let the suit be disposed off in terms of consent decree.

Now, the Petitioner should not surrender before the Police & as such, should move to the concerned court to get the warrant cancelled whether it is a Bailable or Non Bailable Warrant of Arrest. To know the detailed process, kindly connect.
