Withdrawing cyber crime complaint

I reported a complaint on cyber crime 1930 regarding a fraudent transaction via my lost phone via upi, now the person who received the money from my account is ready to return the money to me but his account is freeze by cyber crime, now I want to withdraw my complaint to avoid any further delay in getting my money, police did not file an FIR yet, can I withdraw my case? What should I do if police not taking my withdrawal request saying we need proof that the other person will return the money.
Considering the FIR has not been lodged yet; you will have to write a letter / application to the police station stating that you intend to withdraw the complaint and you no more have grievance against the person. Further, you will have to mention in the same application to unfreeze account.
Well, you seek an undertaking in writing from the opposite person, that, he will return your money, that can be served as a valid evidence in Court of Law. Based on this undertaking, I think, Police will allow you to withdraw your Complaint. If Police won't do anything, then you can file a case in Court.
