Withdrawal of private complaint in magistrate court
21-May-2023 (In Criminal Law)
Sir, police had filed closure report in my complaint. So I filed protest petition against closure report before magistrate. My protest petition was allowed and it was converted into private complaint. But at the same time magistrate told me that I should not pursue case against a particular accused who happened to be a police inspector. Since I found that magistrate was siding with police inspector whom I had arrayed as an accused I withdrew my case as I knew that I won't get justice in that case. I want to pursue the case as magistrate is transferred out. Please guide me in pursuing my remedy. This case is serious and I am continuing to take medical treatment because of the offence committed by one of the accused
once you withdrawn the private complaint before magistrate then you have no remedy to pursue the case for that because once you withdraw the complaint itself over so you cannot proceed further before with Royal you must has think hundred percent that magistrate so you have no remedy because you cannot make an blind equation against a magistrate without proving it is a serious allegation so you should go carefully in this matter
