If there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Yes you can file a divorce petition along with maintenance Against your husband . You have a daughter so your daughter can file for share in the property. If the property is ancestral your daughter has right from birth

sure, you can file for divorce on grounds of cruelty and claim alimony. since you have a daughter as well consider filing a maintenance case for both your daughter and yourself. you can also seek accomodation to stay

You may also seek divorce on legally recognised grounds, depending upon the facts, including cruelty or other applicable grounds. Your husband’s disability by itself does not automatically give you a right to divorce or to claim his property. Please provide the property documents, details of ownership, any Will, family tree and relevant marriage/divorce facts. After examining these documents, the appropriate legal remedy for divorce and property rights can be advised

Vanita ji, in a divorce case you cannot directly claim a share in your husband’s or in-laws’ property/shop. Property rights are a separate legal issue and depend upon ownership and succession documents. However, if you want to proceed for divorce, maintenance/alimony and your daughter’s maintenance, you may proceed with appropriate legal action.
