You should file another complaint and make sure an FIR is filed , if an FIR is filed against you we have to move for an Anticipatory Bail . Everything must be done as soon as possible. When facing potential criminal charges or ongoing disputes, a two-pronged strategy—filing a Cross-Complaint and preparing for Anticipatory Bail—is the most effective way to protect your interests.

Dear Sir, Indian law recognises the right of private defence under Sections 96–106 IPC. If you hit her only to defend yourself, proportionately and without intention to cause serious injury, it can be a valid defence. The key factors are: Who was the initial aggressor Nature of injuries on both sides Whether force used was reasonable and necessary Will arrest happen? Arrest is not automatic. As per Supreme Court guidelines (Arnesh Kumar v. State of Bihar): Police must first issue notice under Section 41A CrPC Arrest is made only if necessary for investigation, risk of absconding, or repeated offence If injuries are simple, arrest is unlikely.

In India, you can be arrested if you hit someone, even in return, but whether the arrest and potential conviction are upheld in court depends entirely on proving your actions were within the legal right of private defense. The law recognizes your right to defend yourself, but it imposes strict conditions and limitations. Key Legal Principles Right to Private Defence: Section 96 of the Indian Penal Code (IPC) states that nothing is an offense if done in the exercise of the right of private defense. This right exists to protect your own body (or another person's) from an immediate, unlawful attack. No Duty to Retreat: Indian law does not require you to run away from an immediate danger; you are permitted to use force to repel the attack. Proportional Force: The force you use must be proportionate to the harm threatened and necessary to stop the attack. If someone slaps you, slapping them back once might be considered proportionate, but using excessive force, such as a severe beating when the threat has passed, can make you the aggressor and liable for assault.
