What to do if a person is accused under section 374 IPC?

1).Since sec.374 is a bailable offence, it is advisable to apply for bail before concerned police station. 2).Thereafter if chargesheet is filed then, important is to see whether the labour is major or minor.3) If he is major, important would be to present document showing that labour was will fully employed and he was payed for it. so salary details or if muster roll would be important.4) Also it may be shown that he was working in friendly environment without there being any forceful act.5)The case would be different in case of labour being minor,in that case it could be shown that the parents of the minor are also employed for that firm and it is parent who employed the minor to work with them.
