What to do if a girl has cheated me and gave false promises.

I got cheated by one lady in USA and would like to file a case in india. Currently she is in Bangalore. There were many things involved. She said she will marry me and we proceed further in relationship for 8 months and then i spend close to 40 Lakhs. Now she left me all of sudden. I came from USA and met her and asked , she said do what you can. Right now i am looking for attorney who can advise me what are the possible options here for me to proceed legally. Please advice me. More than money i lost my name infront of friend colleagues parents relatives. I told to everyone that i am going to marry her, now don't know how to convey this to all. Thank you.

You can try to recover the money if she utilized funds for her personal use without your knowledge providing that you have enough evidence to prove that. Moreover you can file a case under IPC 420 (cheating case) on her although I need to know more insight of the story before providing a meaningful legal advice. Furthermore, if she is returning to US you can proceed with legal actions over there as well. Good Luck.

Hello,

You mentioned that you spent close to 40 lakhs on the woman of 8 months relationship. If you have proofs to show that you spent the said money on the woman you have been involved with, then you can file a money recovery suit in a civil court and recover your money. There should be proper documentation of the money been spent on the woman. Coming to cheating, please note that the element of cheating comes in when a person giving an assurance has no intention of keeping it. For example, if a man/woman who promises a man/woman marriage breaks the promise, it is false representation but his/her intentions have to be looked at. If, at the time of giving such a promise, he/she did not intend getting married, then it would certainly amount to cheating. If for some reason later he/she decided not to marry, then it is not cheating. Mere failure to keep a promise cannot be presumed to be cheating unless such intention was shown when the inducement was given. Thus, filing a case of cheating may not hold water in your case as I presume that no written promise is given by the woman and oral promises will not sustain in court.
