What to do false murder case has been registered

Due to previous enemity with our family. Some body had killed one brother out of 2 at night 9.30 pm in village near our village house.they all.were.muslims and we r only hindu in village but we all leave In town which is 3 km.now they falsely given 7 names in fir all out of which 3 r army retd.persons and 4 one is still serving in bsf on the date of incident he is on duty,his name has been cut from charge sheet also police also cutted one more name from charge sheet ...remaining persons trial is going on from last 16 months and In jail .one is absconder and he is medical admitted in hospital on the date of incident but he didn't know about the case now he want to get relief and how these persons will get bail a case of 302.307.34 etc has been registered. One previously we have gone to high court but rejected In last September.... So suggest me what I will.do pls help.my brother as well as my family persons....

Are you enjoying your bail or you are facing custody trial ?
Please don't go to the upper court
First face the trial and if you are convicted than go to the upper court

Here, in your case circumstances have to be seen. Firstly FIR, Charge Sheet, Circumstancial Evidences, place of Occurrence report and PM report which has been attached with Charge Sheet. Then you have to collect all evidences in your favour to light up the trial. But you can file bail or not it depends upon the case may be. You can obviously file bail before the High Court. But it is seen that the Judge will grant your bail or not. It depends on circumstances and evidences you have as per your query.
