What does 'pabandi nama' mean? What is the definition of pabandi nama?

17-Jul-2024 (In Criminal Law)
I was granted bail in a case under sections 323/506 IPC and 354 POCSO Act in 2015, with the condition that I must sign and report every 2nd Saturday of the month. Today, I received a 'pabandinama' from the police station to appear tomorrow at the ASJ court. Could you please guide me on what I should do next and what 'pabandinama' means in this context? Thank you.

A Pabandi Nama (or Pabandinama) is essentially a written undertaking or restriction agreement, commonly used in legal situations in India and Pakistan. It's like saying to the authorities: "I messed up, but I promise I won't do it again and here's that promise in writing."

It's not a criminal charge, but rather a precautionary legal tool usually used:

  • When someone is caught doing something questionable but not formally arrested or charged.
  • As a condition for bail or release, where the individual agrees to certain restrictions (like not entering a particular area, not repeating the offense, or staying out of trouble).
  • ?As a preventive measure by police to keep peace in the locality kind of like a formal warning on record.

If someone violates the terms of the Pabandi Nama, it can lead to serious consequences like arrest, stricter legal action, or cancellation of bail.
