Legal Remedies Available: 1. Serve a Legal Notice: Send a legal notice to the upper flat owner asking: Immediate repair of leakage. Compensation for inconvenience (optional). Warning of legal action if ignored. --- 2. Approach Housing Society (if applicable): If your building has a Resident Welfare Association (RWA) or Apartment Owners Association, file a written complaint. The association can: Mediate. Impose a fine or take action as per the bylaws. --- 3. File a Complaint with Local Authority: You can approach: Municipal Corporation / Local Ward Office, or Building Maintenance Authority, for inspection and official directions to upper flat owner. --- 4. Civil Suit for Nuisance: If the issue continues: File a civil suit for permanent injunction and damages in civil court. Seek directions for repair and restrain further damage. --- 5. Senior Citizen Protection: Since you’re a senior citizen, also file a complaint under: Maintenance and Welfare of Parents and Senior Citizens Act, 2007, to the District Magistrate or Senior Citizen Helpline.
