Want to know can I withdraw the criminal case from court under section
27-Dec-2023 (In Criminal Law)
I have registered the fir under 420 and 170 section to a person who makes me to fool. Now the case is in court. The accused remanded and now he is in jail. I have applied for recovery of my property. Now I may get job in abroad. Can I withdraw the case ? What is the procedure ? Now case is in the stage of sending notice to accused person.he is also having lawyers.
you can go to any country and withdrawal of complaint is not necessary, if you forgive the accused you may file an affidavit to withdraw complaint. however the court have to decide about it. The accused was remanded after lot of efforts and cost of government, hence i suggest not to withdraw.

you have to file a withdraw petition along with affidavit to withdraw the complaint. where must be stated you have no objection if the accused person realise from the case. before the judge. the compliment and the accused person must be present on that day of hereing.
