Violation of Curfew. IPC 188. Will it create problems in future?
26-Jul-2023 (In Criminal Law)
Today I was booked for violation of lockdown curfew at midnight 12. I was taken to a police station and they noted all my details and than granted bail after collecting Tax bill.
My situation is is this
I'm very seriously preparing for UPSC civil services exam so would this matter be considered as a criminal record because of which I may face problem in my selection?
Generally the police directly registers the F.I.R, but if we see procedure then first police have to give a written complaint to the magistrate and then magistrate have to decide whether to register a F.I.R or not. You may go through section 195 CrPC, read it, it will clear your doubts. Show the court about this section once you are been summoned to the court. It may be dismissed.
