The legal remedy depends on the nature of the material that the other person is threatening to circulate. Only after examining that can it be properly decided whether the matter is civil, criminal, or both. If the act amounts to a criminal offence and the police do not take proper action, a private complaint may have to be filed before the competent court. Since the facts provided are incomplete, a proper legal opinion cannot be given at this stage. For appropriate legal advice and further steps, you may contact me.

Dear Sir/Madam, I understand that you are facing false allegations regarding the spreading of private data with an intention to defame. Such accusations are serious in nature and can have legal consequences if not addressed promptly. At the outset, it is important to assess whether any actual data was shared and, if so, the context and intent behind it. In cases of false allegations, the law provides remedies to protect your reputation. You may initiate appropriate legal action for defamation and also seek to restrain the opposite party from making further baseless claims. Simultaneously, a carefully drafted reply to the allegations is crucial, clearly denying the claims and placing the true facts on record. If required, we can also explore filing a complaint against the person making false accusations for harassment and misuse of legal provisions. I recommend gathering all relevant communications and evidence to build a strong defence. I would be happy to assist you in drafting a detailed reply and advising you on the next legal steps. Kindly let me know how you wish to proceed.
