Under the Bharatiya Nagarik Suraksha Sanhita (BNSS) and Bharatiya Nyaya Sanhita (BNS), the time limit for filing a chargesheet depends on the nature and severity of the offense. For serious offenses punishable with life imprisonment or death, the chargesheet must be filed within 90 days from the date of arrest or taking cognizance, depending on the context. For offenses punishable with up to 10 years of imprisonment, the timeline is 60 days. In cases triable by the Court of Sessions, the Magistrate may extend the filing period up to 180 days, provided valid reasons are recorded in writing. These timelines are crucial because if the chargesheet is not filed within the stipulated period, the accused becomes eligible for default bail under the law.

Under the Bharatiya Nyaya Sanhita (BNS), the time limit for filing a chargesheet depends on the offense’s punishment. As per CrPC provisions (which still apply), for offenses punishable with imprisonment up to 3 years, the chargesheet must be filed within 60 days; for more serious offenses, the limit is 90 days.

The time limit to lodge an FIR under BNS isn't explicitly stated, but according to the Supreme Court, for grave offenses, an FIR can be lodged even after a delay of 15 days. However, it's essential to note that a delay of three months may weaken your case.

No, there is no time limit to file Chargesheet in Court. However, if the accused is arrested and still the Chargesheet is not filed within 60/90 days (as the case may be), then in such situation the Accused is entitled for a Default Bail under BNSS. In case you want the chargesheet to be filed, you can approach the District Court by filing an application u/s. 156(3) of CrPC to monitor the investigation and to direct the police for filing the chargesheet urgently. In case you want further legal assistance, you can directly approach me.
