Threatening family and blackmailing after being in a relationship
24-Mar-2025 (In Criminal Law)
Sir, I have been in realation with this person since 2013 and everytime any issue happened he involved my family. In 2023, he threatened me and the issue got out of hand so both families had interfered and talked it out to keep both of us away. But since 2024 he approached me again in the pretense of good behaviour and I happened to talk and we went on trips together hiding everything from families. Now again because of our issues he started blackmailing me and threatening to defame our family.
Since your ex-partner is blackmailing and threatening to defame your family, you can take strong legal action against him. Here’s what you should do:
1. File a Criminal Complaint (Blackmail & Threats)
Approach the police and file an FIR under the following sections of the Indian Penal Code (IPC):
Section 503 IPC – Criminal intimidation (threatening to harm or defame)
Section 506 IPC – Punishment for criminal intimidation
Section 499 & 500 IPC – Defamation (if he spreads false information about you or your family)
Section 384 IPC – Extortion (if he demands money or any favor in exchange for not defaming you)
Section 509 IPC – Insulting the modesty of a woman (if his actions include harassment, abusive language, or inappropriate behavior)
2. Gather Evidence
Keep screenshots of his messages, calls, and emails where he is blackmailing you.
Save any voice recordings or videos where he threatens you.
If you have witnesses who can confirm his threats, that will strengthen your case.
3. Apply for a Restraining Order (Injunction)
If you feel unsafe, you can seek a restraining order or an injunction under Section 18 of the Domestic Violence Act, preventing him from contacting you or your family.
4. Cyber Crime Complaint (If Digital Blackmail Involved)
If he is blackmailing you online, spreading rumors on social media, or threatening to leak personal information, file a cybercrime complaint under the IT Act, 2000.
5. Inform Your Family (If Comfortable)
Since he has a pattern of involving your family, consider informing them in advance so they are aware of his tactics.
Next Steps
Visit the nearest police station and file a complaint.
If the police do not take immediate action, you can approach the Magistrate’s Court and file a private complaint.
If you need help drafting the complaint or taking legal action, a lawyer can assist in filing the FIR and legal notices.
