Threat of Murder for property from brother
08-Jun-2025 (In Criminal Law)
My brother has been threatening to kill me over property. He wants all the property for himself. I have a video recording in which he explicitly states his intent to kill me. He has been unemployed for the past 10 years and has never held a job. He refuses to work and has repeatedly told me that he constantly thinks about killing me.
If your brother is threatening to kill you over a property dispute and you have a video recording where he explicitly makes such threats, you should immediately take legal action to protect yourself. His conduct amounts to criminal intimidation under Section 506 of the Indian Penal Code (IPC), and the persistent nature of these threats may also fall under Section 503 IPC. You should file a detailed written complaint at the nearest police station, clearly mentioning the history of threats, his intent as shown in the recording, and the property dispute. Attach the video recording as evidence. If the police do not take adequate action or fail to register an FIR, you can approach the jurisdictional Magistrate under Section 156(3) of the CrPC, requesting the court to direct the police to investigate the matter. Simultaneously, if you are in fear of immediate harm, you can seek protection and also file for a restraining orde from the civil court to prevent him from entering your premises or threatening you further. It is important not to ignore such threats and act swiftly through legal channels. If needed, I can assist you in drafting the complaint and guiding you through the legal process.
The property which u mentioned is it a joint property /ancestral or solely owned by u ?. U should file a criminal complaint case against him as the recordings are enough evidence and can be filled along with the complaint case. Regarding property should also take steps to ensure that it is brought on records in govt records .Contact me for any help.
