Q: Can we file a case against the abettor for suicide?

If a boy wants to commit suicide.Ya tries to commit suicide but the boy's family already stops the boy.So can the boy file a case of abetment to commit suicide who instigated him to commit suicide or forced him to commit suicide? If he can file a case, then how many years will be the punishment for the boy against whom he will file the case?what is the ipc on them,And what to write in FIR...???? please tell me

Advocate Yash Nagar answered
Hello, section 306 of the Indian Penal Code deals with the abetment of the suicide but the section only comes into force when there is a suicide, I mean when someone commits suicide not before that. So as of now you can't register a FIR against the person on the charge of abetment of suicide but there may be other sections applicable which depends on the evidence which you have at present, and if you only want to threaten the other person then the legal notice will also help.

Q: Can I get my SIM card reissued from the sim operator if its in police

Police has taken my phone and the sim in it in police custody with any proper documents stating the requirement of my phone and sim in it. It is a 420 which involved me for a investigation. The SIM card in the phone is attached to my bank account, credit card portal, aadhaar, extra. To access my credit card portal i need to enter OTP thats sent to that sim number. Can i get the sim card reissued atleast for the sake of opening my portal and paying the due fees? Or is it not recommended to get my SIM card reissued if its in the police custody?

Advocate Yash Nagar answered
Hello, if the mobile or sim is the evidence in the case then I would suggest you not to proceed with duplicate sim otherwise it will create another problem for you. In this case we have to approach the concerned Hon'ble High Court for the same if you are not the main accused or the mobile is not related to the crime in the question and the Hon'ble High Court will grant you permission to take your sim back from the police themselves.

Q: Police is calling from different state and saying that an FIR is lodge

Police is calling me from different state and saying that an FIR is lodged against me u/s 507. And calling to meet him and asking me to provide him my aadhar card and photo. But I didn't receive any type of notice or anything in writing yet. What should I do know? The FIR or complaint in question is from different state and I'm from different state .

Advocate Yash Nagar answered
Hello, the offence u/s 507 IPC is a non cognizable offence, it means that police can't register a FIR against you but they have to register a non cognizable report against you, in general language we call it complaint or अदम चेक। If they again call you tell them to send the complaint to your WhatsApp and do record every call from them. We can send a legal notice to them to get all the information.

Q: College authority is demanding money for handing over my mark sheets

I did my engineering in 2005 but recently lost my mark sheets. I reissued my mark sheets from the university. University sent the mark sheets to the college but the college authority is demanding money(Rs 50000) for handing over my mark sheets in the name of dues. I didn't have any dues. Now, what should I do?

Advocate Yash Nagar answered
Hello, is your college a private one or a government one? First thing which you have to do is to serve them with a legal notice, in which I can help. Secondly if your college is a government one then after the notice we can directly approach the concerned Hon'ble high court and if it's a private one then we have to go through the other way.

The offences under these sections are not compoundable and therefore the case cannot be withdrawn, the girl (victim) can change her statement in the trial which will help the accused in future to get bail.
