Threat from a business for defamation case for online review
16-Jul-2023 (In Criminal Law)
Google reviews about a counselling clinic were written for bad service with patient, like blaming, verbal attacks, etc. They emailed us saying they will proceed with doing FIR and filing for Defamation case with police cybercell and asked to remove review. In email they said they have found my contact info, work place from police. In the review I mentioned "third class", "cheater" therapist, as they took money and gave bad service. Can defamation case and FIR be really be really filed by them?
In India we have the fundamental right to speech. For the most part, reviews are covered under the fundamental right- protection of free speech.
If a customer posts a review that is factually inaccurate or contains accusations about the business that are untrue, he can be sued the online reviewer for defamation.
