The FIR was lodged against me as there was a small fight, how to get medico legal certificate ?

17-Jul-2024 (In Criminal Law)
The FIR was lodged against me as there was a small fight. The complainant was discharged from hospital after 20 mins according to his MLC . He has bribed the private hospital and the IO of the case to get the MLC openion as (Grevious). who can issue medico legal certificate?, According to the MLC the doctor's openion was reserved after 6 days of the incidence and then after 6 days , the doctor made his openion as grevious . In the chargesheet the IO has added IPC 325 . I have not beaten the complainant, but there was pushing of each other. He was not injured at all. How to Challenge fake MLC in court in this case ??? Does the doctor was not aware even after 6 days of fight to give his openion whether simple of grevious. My question is how to prove this MLC wrong and what legal steps can be taken against hospital for making fake MLC ?

if you are convinced that the MLC is fake, you may file a complaint against the doctor raising all the grounds that you've just mentioned. this complaint will also help you in your case, since you can use this as an evidence/ supporting document, in your case to show that MLC was fake.

a)MLC is considered as an expert evidence in the criminal trial and is considered as an evidence under section 3 of IEA. b) His evidence is of advisory character. c) An expert deposes and does not decide. d) An expert witness is to furnish the judge necessary scientific criteria for testing the accuracy of the conclusion so as to enable the judge to form his independent judgment by application of the criteria to the facts proved by the evidence. Value of expert opinion:- The Expert evidence has two aspects a) Data evidence [it can’t be rejected if it is inconsistent to oral evidence] b) if it is inconsistent with the nature and gravity of offense stated in the F.I.R it can be rejected solely on that ground.
