suspension in case of Central PSU employee in a criminal case reg.

A FIR u/s 406/409/420/120B IPC was lodged against a Central PSU Employee w.r.t. disputes arising in a Public charitable trust in which the Central PSU Employee as also the complainant were members. Based on FIR, investigation officer was appointed. IO submitted chargesheet in Court u/s 420/468/471, thereafter, the complaint case was disposed and fresh criminal case was filed as State vs …. No arrests were made as not required as per chargesheet. Subsequently, Court grants bail and further proceeding starts. Can the Central PSU employee be suspended / promotions kept under hold by his office in such case.

No. The central psu employee cannot be suspended and his promotion cannot be kept under hold pending outcome of criminal proceedings. The presumption under law is innocent unless proven guilty. Suspension and other actions amounting to taking punitive action is like punishing for something which has not been proven.

yes probably psu can take such steps now or afterwards on discipline part however there are remedy against same as well. you need to persue your criminal matter seriously and simaltanously try to get this matter quashed.
