Summons to skip? Or not? My Lawyer seems compromised with opposite pa

17-Oct-2023 (In Criminal Law)
What if I don't attend the court for 3 consecutive summons on a reason that I did not receive the summons (false cheating case 417),.. Will I get the arrest warrant??? Please suggest me.. My lawyer is simply asking me to not to attend even for third summon because I did not get the summons. How far I am safe?? Indeed I am ok to attend. Why is lawyer misguiding me?

in this case as soon as you appear in court you are required to give surety and get bail as it is a criminal case, there is nothing in law station summons has to be issued 3 times etc, once the summons is served and if you do not attend and get bail an arrest warrant will be issued, so better attend the court and get bail first.

Hi, on the basis of the query that you have posted kindly note if the summons served upon you is under the CRPC in a cognizable offence where you are the accused, then you better apply for a bail through your lawyer. In case the bail is not granted then you will have to surrender to the court for judicial or police custody to carryout the investigation and trial.

A summons or notice to appear is a court order. If you do not appear as ordered, you have violated the court order and may face serious consequences, Not getting summons is a good excuse but today or tomorrow you have to appear before the judge , as police will track you down easily to summon in the manner which they like.before they take other ways, when you have knowledge of the case appear with the help of your lawyer and get regular bail and keep calm and carrying on defending your case.
