Suggestions during cross-examination

27-Sep-2025 (In Criminal Law)
During cross I shall read what PW1 has mentioned in her written compliant. E.g. In your written complaint you have written I was terminated from the company is that correct? I put it to you that you falsely mentioned I was terminated from the company due to previous enmity. Will court record both the statement or only the second statement?

Dear Sir, When you read from PW1’s written complaint and ask: “In your written complaint you have written I was terminated from the company, is that correct?” – this part will be recorded as a question put to PW1 and PW1’s answer will be written down. When you follow it with: “I put it to you that you falsely mentioned I was terminated from the company due to previous enmity” – this will also be recorded as a suggestion/imputation put to the witness along with PW1’s denial or admission. Therefore, both portions get recorded – (i) the reference to her earlier statement/complaint, and (ii) your suggestion of falsity. The judge will not omit the first part, because the context of the question is important for the witness’s answer and for the court’s appreciation of evidence.
