Sexual offence in childhood age

I would like to know in year 2009 if a 16 year old boy try to have sex with a girl when she disagree to it and put off her underwear then the boy realizes his mistake and put the underwear on to the girl without touching her. Would it be considered as an offence? If it does then how can the boy safe gaurd himself from being punished by the court?
