Seeking Advice on Reopening Investigation for Weak Charge Sheet

07-Jan-2025 (In Criminal Law)
Subject: Help Needed to Reopen Investigation Dear Legal Experts, I am the complainant in a criminal case at the Metropolitan Magistrate Court, Bandra West. The police submitted a weak charge sheet and are uncooperative. Critical evidence has been ignored. Case is ipc 420 and I am a victim of financial fraud . How can I request the court to reopen the investigation? Or should I request the additional police commissioner or dcp? Please advise on the process and relevant legal provisions.

Well, rather than requesting ACP or Commissioner of Police to get your case reinvestigated. Better you approach Court, I can assist you in getting this reinvestigation done via filing an Application in Court under the concerned provisions of law.

once the chargesheet is submitted with the court, you have several remedies. 1. you can appoint your own advocate to assist public prosecutor. 2.you can file application with district and sessions court for further investigation/re investigation 3. you can file writ at high court for further investigation of the case by invoking the inherent power of the high court and ask for re investigation in your case by producing evidence. 4. you can file directive petition at High court.
