Seeking Advice: Criminal Defamation Complaint Over Hotel Review

I stayed one night at a Lucknow hotel and had a genuinely poor experience (room smell, ironing issue, bad food). I posted one Instagram reel sharing my personal dissatisfaction using strong language like “never book this hotel.” I did not accuse them of fraud or crime, nor demand money. The reel got 80k views. The hotel has now filed a private criminal defamation complaint under Section 356 BNS. I’m concerned about legal risk and visa impact.

If you have merely shared your genuine experience without making false factual allegations, the offence of defamation under Section 356 BNS may not be made out. Truth, expressed in good faith and as an opinion, is a valid defence. Strong language alone is not defamation unless it imputes false facts harming reputation. Since this is a private complaint, the Magistrate must first take cognizance and issue summons. It is bailable and non-cognizable. You should preserve bills, booking details, and any proof of your stay to establish truth and good faith. As far as visa impact is concerned, mere filing of a complaint does not affect travel. I suggest you to go for quashing of the case.

Truth is an absolute defense under Section 356 BNS. Your review falls under the First and Ninth Exceptions as a good-faith imputation for public good. Keep all bills and photos as evidence of your stay. Private complaints are often used to intimidate, but they rarely impact visa status without a conviction.
