Section 156 CrPc Powers Of Magistrate

Why even Magistrate denies for registering a FIR under 156 CrPc stating I believe Prosecution can prove the allegations by leading evidence. So request is denied for registration of FIR.

If you feel that the concerned magistrate mis appreciated the evidences and facts contained in the application under 156(3) of the crpc, then you may approach to the court of sessions by filing a revision application in section 379 of crpc with the impugned order by citing the grounds why your application can not be denied.

This order can be challenged before the sessions judge. Judge can not reject the application blatantly. You should challenge the order. Please feel free to reach out to me for any further assistance
