u/s 303(2) of BNS 2023 say that if the value is less than 5000 then it is N.C. case .Here without taking magistrate permission, the Police filed F.I.R. and chargesheet for the value of 2000.The 27th MM Court has given the case number as PW case .QUESTION : Can the Accused : do “taken on board” request at the same court and make a request for dismissal of the case due to procedural irregularity / defect or request the court to convert the PW trail into summary trail ?

Dismissal of the case can be done, if the law permits. However, it is better that you move the discharge application on the date of hearing itself.
For converting the PW case to summary trial, you can also move the application on the daye of hearing itself.
