RTI for certified copies of FIR from outside India

20-Jan-2026 (In Criminal Law)
Person used to be Indian citizen/resident at the time of CAW complaint and FIR, but not anymore. Trying to do this w/o hiring local lawyer. Is Online RTI the best way to get certified copies of past police complaint / FIR when person now lives outside India, or should they email the PIO directly? How to achieve this without providing international address but person is comfortable to provide email address. Will CAW Cell and police station need address? Thank you

If the person now lives outside India, they can easily get a copy of the CAW complaint or FIR by filing an Online RTI. It should be addressed to the Public Information Officer (PIO) of the police station or CAW Cell where the case was filed. They can mention their email ID for communication and simply write “currently residing outside India” instead of giving a full international address. If the FIR is still active, the person can get it cancelled or closed by the High Court. For that, a local lawyer in India will be required to file the case in the concerned High Court.

Online RTI is the most practical option. Indian address is not mandatory; email is sufficient. PIO may insist on identity proof. Police/CAW may ask past address for record linkage, not current foreign address.

A person who was an Indian citizen/resident at the time of the CAW complaint/FIR can still seek certified copies even if they are presently residing outside India. Filing an Online RTI under the RTI Act, 2005 is generally the most practical method, as physical presence in India is not mandatory. The RTI application can be filed mentioning an email address for communication and requesting supply of certified copies by email or scanned copies. Many police authorities now provide replies electronically.

Yes, you can obtain certified copies of a past CAW complaint or FIR even if you are now residing outside India, and you do not need to hire a local lawyer for this purpose. The most practical and legally correct route is to file an online RTI application. Under the Right to Information Act, 2005, there is no requirement that the applicant must be currently residing in India or must provide an Indian address. You may provide an email address for correspondence and request that the information or copies be sent in scanned form by email. Many police departments and CAW Cells now routinely supply FIR copies and complaint details electronically. While filing the RTI, clearly mention that you are the complainant or affected party in the case and provide identifying details such as FIR number, date, police station, CAW Cell reference number, names of parties, and year. This helps the Public Information Officer locate the record without insisting on a physical address. Providing an international address is not mandatory. If the RTI portal asks for an address field, you may give your last known Indian address or mention “presently residing abroad” and rely primarily on email communication. The law does not permit rejection of an RTI application merely because the applicant resides outside India. Directly emailing the PIO is not as effective or legally enforceable as an RTI application. RTI creates a statutory obligation with timelines and appeal rights, whereas emails can be ignored without consequence. Therefore, online RTI is the better option. Police stations or CAW Cells do not require your current residential address for issuing certified copies of FIRs or complaints. Identity is usually verified through case details and, if required, a self-attested ID proof attached digitally. If certified physical copies are specifically required (for court use), the RTI reply can be used to request certified copies through post, or a trusted person in India can collect them on your behalf with an authorization letter. However, in most cases, scanned certified copies issued under RTI are accepted for legal purposes, especially for reference, quashing petitions, or preliminary filings. In summary, file an online RTI, use email as the mode of communication, do not worry about international address disclosure, and avoid informal email requests to the police. This is the safest, cleanest, and legally protected way to obtain the documents while residing abroad.

Sir, firstly an RTI can be filed by an Indian Citizen only and it needs to be declared in your RTI application. Secondly, the address of the applicant needs to be revealed while filling the said application. However, there are other legal methods by which, you may procure the certified copies.
