As you are working in Shillong and unable to attend the hearings with this regard your counsel can file a formal exemption application before the Hon'ble Court requesting an exemption from personal appearance specifying your job posting in Shillong and your next doubt you can withdraw the case as the purpose was resolved, you have recovered the phone.

In Delhi you can always attend the court proceedings via video conferencing. And if you haven't taken your phone then you need to file an superdari application in the court to claim your phone back. For more legal assistance I am just a call away.

Since your mobile phone has been recovered, the investigation may continue until the police file the appropriate report before the court. As the complainant, you cannot unilaterally seek closure of the criminal case if a cognizable offence has been registered. However, you may inform the Investigating Officer and the Court that your phone has been recovered and that you have no further grievance. If your personal presence is required, you may move an application through an advocate seeking exemption from personal appearance, stating that you are presently employed in Shillong and are unable to attend each hearing. In appropriate cases, the Court may permit representation through counsel and require your presence only when necessary, such as for recording evidence. Engage a local advocate at Saket Courts to represent you and file the necessary applications on your behalf.
