Representation under free legal aid lawyer for a civil case-DLSA

19-Sep-2025 (In Criminal Law)
I am Chandrima Roy , from NOIDA (INDIA) now based in Dubai for work. Before filing civil case with free legal aid lawyer at Tis Hazari court about financial fraud in my money recovery case, wanted to know if my family/ex-colleagues are unable to help me represent in court because of their own health & job issues. Since representation is a mandate since i m working in Dubai & may not be able to come for the case everytime.

Since you are based in Dubai, you need not depend on family or ex-colleagues to represent you in court. You can appoint an advocate at Tis Hazari by executing a Vakalatnama/Power of Attorney in their favour. Your personal presence will only be required at specific stages if the court insists, otherwise your counsel can conduct the proceedings on your behalf. If you qualify for free legal aid, the court can also provide you a lawyer. This way your work abroad will not stop the case from moving forward.

You can always get a SPA (special power of attorney) executed in favor of the person to whom you wish to fight on behalf of you. And as far as the money recovery suit is concerned you should also file a criminal case against the accused person.

Hi there, speak to your legal aid lawyer and ask him to take an exception from court by filing an exemption application before the concerned judge. You might still need to attend court through video conferencing. You can also make a Power of attorney in favour of your relative/friend to represent you in court. If you have any questions feel free to contact me.

You can authorize an advocate in India to appear on your behalf by signing a Vakalatnama. The advocate handles all legal formalities, including appearances. Since you're getting free legal aid, the assigned lawyer will likely take this up. This is the standard procedure, and it’s fully valid even if you are living abroad. If you want a trusted person (family, friend, or ex-colleague) to appear on your behalf (not as a lawyer, but as a representative), you can issue a General Power of Attorney. This allows them to: Appear in court, Submit documents, Give limited statements (as authorized). It must be notarized and attested via the Indian Embassy/Consulate in Dubai. After that, it must be adjudicated in India (presented to the appropriate registrar/stamp office). Courts sometimes allow: Affidavits in place of personal appearance, Video conferencing for cross-examination, especially for NRIs or people abroad, You will need to request this specifically through your advocate and the court must permit it.
