Regarding the process of anticipatory bail
17-May-2023 (In Criminal Law)
My grandmother had done a sale of a property in which my father is a witness. Declaring the bond as fake, an opponent got an FIR written under non-bailable sections 419, 420, 467 etc., and the case was sent to court? But now when its number came, my grandmother who was the main party has died. Still, my father's warrant was cut, if so how will he get bail, can I get anticipatory bail from the High Court? Can case could be continued after the death of main party?
You can get anticipatory bail from the district judge there. But before that you should tell what the complainant has written in the FIR, due to which your father needed bail, the property which was sold by your grandmother was not his or the one who sold it could not take possession.
firstly you can move anticipatory bail in sessioncourt except the high court because in you mater where the main accused is no more then the court may released on anticipatory bail.
after some efforts you can also get the anticipatory bail order
after some efforts you can also get the anticipatory bail order
yes you can apply for anticipatory bail from high court under 482 crpc... but it is not soo easy later on you have valid reason .. case is from which district and send me your fir details and all the documents so that I can suggest you better relief and I will try it on high court too .. call me for further discussion
the case against your father will proceed. if he hasn't been arrested till date and the chargesheet has not be filed in the matter your father should apply for anticipatory bail. otherwise he should apply for a regular bail.
She can apply for surrender bail from Hon'ble Court for that an application has to be moved before the court which jurisdiction and accused has to surrender before Hon'ble Court but that is discretion of Honorable Court give bail or not . while applying for anticipatory bail may or may not provide relief to be accused.
