Regarding Police Call for Court Appearance in Public Drinking Case

18-Mar-2026 (In Criminal Law)
On 28 Dec 2025 in Gurugram, police detained me and my friend for drinking near a wine shop, noted our details, took Aadhaar photos, and released us saying no action would follow. After two months, I received a call to appear near Rajeev Chowk with a surety, without any FIR or written notice. I seek advice on legality, need for bail/lawyer, and correct steps.

It appears an FIR has likely been registered against you under the Excise Act and possibly for minor offences like affray/public nuisance. You should not ignore the call—appear as directed. These are bailable offences, so you will likely be released on bail/surety the same day. Engage a local lawyer, verify the FIR, and appear with a surety. You will then have to appear before the court and contest the case on merits.

Hello sir please let me know what is next date of hearing or your case? You have to appear before the magistrate along with a surety and identifier in person. You will get the bail on the same day no need to worry

The police call is likely to formalize a 'Challan' for the public drinking incident. While they can call you, you have the right to a written notice. Go to the police station (not a public spot like Rajeev Chowk) with an adv or a person who can stand as your surety. Once the fine is paid in court, the matter will be closed and will not result in a permanent criminal record for such a petty offense.
