Regarding IPC 500,506,509 in crpc 200 complaint case

04-Apr-2023 (In Criminal Law)

1. Offences can be added after filing of application under Section 156(3) and if the FIR is lodged upon it even then further offences can be added in the chargesheet and even after that as well as even the chargesheet is not bound by investigation. 2. The magistrate has the power to direct the police to conduct investigation upon receiving an application under Sec. 156(3) 3. If the police officer has served you a notice whether electronically or physically you are required to join the investigating. 4. If the accused person doesn't join investigation te police officer can arrest in that case upon warrant quoting the reason that the arrest is necessary. 5. If the FIR is lodged and only bailable offences are made out then the bail will be provided as a matter of right. Though, it's not recommended to not join the investigating as it would only weaken one's ground for seeking bail. For further expert advice, you may contact me.
