Regarding Criminal Case.... Criminal Is Out Of India

I filled rape case and IT act case against one boy...I got to know that he is in Canada right now. His advocate said he took permission from court. With PP I checked the file but I didn't see any permission in the court where our case is running. Is it possible?

Issuance of Warrant The court can issue a Non-Bailable Warrant (NBW) if the accused is not appearing despite summons. 2. Proclamation & Attachment (Section 82 & 83 CrPC) If the accused absconds or is deliberately avoiding the process of law, the court may declare them as a Proclaimed Offender (PO) and order attachment of property. 3. Look-Out Circular (LOC) Police can request issuance of a LOC to prevent the accused from re-entering India without arrest. 4. Extradition Process For serious crimes, if the accused is in a foreign country, the Government of India (through the Ministry of External Affairs)

Well, his Advocate may have lied to you! You proceed to seek Certified Copy of all Records and Proceedings from the concerned Trial Court, you will figure out from those papers, whether he has got Bail or not!

for any application which is filed before the metropolitan magistrate, it gets numbered separately, if charges are not framed and the plea of the Accused is not recorded, and in the same application summons is issued to the investigation Officer for their reply, you can check it online the order of copy would be available using the FIR number
