Regarding compromise of pocso case in which FIR has been Filed

Sir, near by neighbor has misbehaved with our child and with a help of our street members we warned him and asked him to move out of our colony but someone nearby have dialed 100 and police came to our house and forced us to give the complaint and sign in the FIR and arrested him on the grounds of POCSO act , Now we don't want carry out these procedure by keeping the future of child in mind, is there any possible way to quash or compromise , we still didn't give the statement to magistrate ,it just happened around this week only... Please suggest sir

Offense under the POCSO Act is a serious one and pedophiles must be punished. In the given scenario you cannot compromise or quash the FIR as the accused had already been arrested and remanded I suppose. If you are thinking about withdrawal of complaint then it will come against you as if you had given a false complaint. In your case public witness is also there. Children are well protected in POCSO proceedings.

In this matter, In a major ruling, the Madras High Court has said that any offence committed under the POCSO Act is not a compoundable offence, even if the victim later changes their mind and develops a relationship with the convict.
