Regarding appearance in UPSC. Conviction under IPC 279 and 338.

I have a criminal case against my under IPC 279 (Rash driving) and 338 (causing grievous hurt by act endangering life or personal safety of others). I was advised by my Advocate to plead guilty. I had pleaded guilty to that charge and I was asked to pay a fine of Rs.1800/-. the case has been disposed of. Can I appear for the Civil Services Examination.

Section 279 in The Indian Penal Code

279. Rash driving or riding on a public way.—Whoever drives any vehicle, or rides, on any public way in a manner so rash or negligent as to endanger human life, or to be likely to cause hurt or injury to any other person, shall be punished with im­prisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.

Section 338 in The Indian Penal Code

338. Causing grievous hurt by act endangering life or personal safety of others.—Whoever causes grievous hurt to any person by doing any act so rashly or negligently as to endanger human life, or the personal safety of others, shall be punished with impris­onment of either description for a term which may extend to two years, or with fine which may extend to one thousand rupees, or with both.

According to Section 320(8) of the CrPC, the compounding of an offence under Section 320 of the CrPC has the effect of acquitting the accused with whom the offence was compounded.

The result of compounding an offence is essentially the dismissal of the accusations made against the accused. It makes no difference whether the FIR was lodged or whether the trial had begun; as long as the offence was compounded with the court’s authorization, the offender is acquitted of all accusations.
