Now second friend with his mother present pledged his gold on my name they told me they need money as my friend does not had a job at that I agreed on it. They both were physically present with me when the muthoot gold loan was processing. I received 190000 rs from muthoot from which I have paid 120000 back.

The first transaction appears to be fully settled, as the ₹80,000 received was already repaid through a bank transaction. The bank record will be strong evidence of repayment, and any further claim by the first friend can be contested on that basis. As regards the second transaction, the position is different. The friend and his mother voluntarily brought and pledged their gold in your client’s name with Muthoot, and both were physically present during the loan processing. ₹1,90,000 was disbursed, out of which ₹1,20,000 has already been repaid. Therefore, we should first establish through the Muthoot loan documents, bank statement and WhatsApp/messages that the loan was taken at their request for their financial requirement and that the gold belonged to them. On the basis of these documents, we can issue a legal notice demanding that they discharge the remaining liability and indemnify the client against the loan. If the evidence also establishes dishonest intention or deception from the inception, appropriate criminal proceedings can additionally be considered; otherwise, a civil recovery/indemnity remedy would be the safer course.

The first transaction can be proved through your bank records showing repayment. For the gold loan, preserve the loan documents, payment records, and any messages/evidence showing that your friend and his mother were present and requested/consented to the pledge. Your liability will depend on the loan documents and who is legally recorded as the borrower/pledger.

it seems that you are mixing two separate matters. in the first matter since you have paid back your friend through bank transaction the entire amount or amount exceeding what you have received then you have nothing to worry about

You can first make an Intimation Letter cum complaint to the SHO concerned wherein you can mention the fact of your side and meanwhile you can also issue a legal notice for recovery of your amount which was given to the second person l. Also yif you have documents then please show them to a counsel for better advise.
