Refusal to Shift as a Tenant Citing Non-Essential Laws

02-Jan-2025 (In Criminal Law)
I’m seeking legal advice regarding a tenancy issue. Despite providing all assurances for a rental agreement to be submitted with 5 days the society refused my entry, citing Maharashtra law, and kept me my wife and 4 year old child waiting for hours. I incurred ₹6,000 in moving costs and lost ₹15,000 in a security deposit. I seek guidance on whether the society had the right to refuse me and how I can claim compensation for my financial and emotional losses.

Under the Maharashtra Ownership Flats Act, 1963 and the Model Bye-laws for Housing Societies, societies cannot deny entry to tenants without valid reasons or legal orders. You may file a grievance with the Registrar of Societies under Section 73 of the Act for unjust actions and compensation. Additionally, under the Consumer Protection Act, 2019, you can claim redress for financial and emotional losses due to deficiency in service.
