Recovery of found vehicle from police or court which was stolen.

Sir my vehicle was stolen and then found which was not in my name but my uncles name. Can police or court give the handover to me of the vehicle without asking my uncle to come as he stays in different city.

no that u have to go with proceedings only section say that regarding the power of the Court to restore possession of immovable property. This Section states that if it appears to the Court that a person convicted of criminal force or intimidation dispossessed some person of immovable property, the court can order for recovery of such property to that person.

You take power of attorney from your uncle and thereafter file application before Court. Otherwise court may require your uncle's presence. In alternatively your uncle get affirmation done in his city while filling application and later through VC matter can be attended.
