Hi,
I want to file a rape case against my brother.He has done all things forcefully with me.
I have no idea at that time what he is doing with me so my case is delayed.So please let me know how can i file a case against him as I am only proof against him and what all procedure is required for doing it.

on the above mentioned query one thing I tell you about rape that in the rape case the victim is the whole sole witness of the type of accident or rape . so don't hesitate that you have no proof of rape because you are the victim and your brother is the accused . so the answer is when you are mentally prepared then you can file FIR aur complaint case against him .

there is no time limit for lodging a FIR for rape. You first have to lodge a FIR at the concerned police station and reveal the whole gruesome story and mental trauma which you gone through and then after registration of FIR the person will be arrested and prosecuted.
if the police men refuses to lodge a FIR then go to the magistrate under sec 156(3).
