If a travel agent has taken money for booking and is intentionally not returning it, it amounts to cheating and criminal breach of trust. You may lodge an FIR under Section 420 IPC / Section 318 BNS (cheating) and Section 406 IPC / Section 316 BNS (criminal breach of trust) at the local police station. Preserve all proofs like payment receipts, messages, emails and booking details. You may also send a legal notice demanding refund and simultaneously file a complaint before the Consumer Forum for deficiency of service and recovery of money with compensation.

You can file a police complaint for cheating (IPC 420) and breach of trust. Keep all payment proofs and messages. Also send a legal notice and file consumer complaint for refund with compensation. At last what was the booking amount ?

In cases of cheating by a travel agent and non-refund of booking amount, the first step is to issue a legal notice demanding refund of the amount within a stipulated time. If the travel agent denies the claim or fails to respond to the legal notice, appropriate legal action can be initiated, which includes: 1. Filing a criminal complaint at the concerned Police Station for offences such as cheating and criminal breach of trust under the Indian Penal Code. 2. Initiating proceedings before the appropriate court, including: • A criminal case for cheating, and/or • A consumer complaint before the Consumer Forum for deficiency in service and unfair trade practice, seeking refund and compensation.

You can file a criminal complaint for cheating and criminal breach of trust under BNS (earlier IPC 406/420). Preserve receipts, chats, invoices. Also send legal notice and pursue consumer/civil recovery simultaneously.
