Questions regarding Filing of chargesheet in court

16-Apr-2026 (In Criminal Law)
I complained to ACP for non filing of chargesheet in court from past 1 year. In reply the SHO stated that "chargesheet is completed and were sent to court through ROAD CERTIFICATES on 10/11/2025. But the same couldn't be accepted by the court." And chargesheet is not re-submitted till today 1. What is the ROAD CERTIFICATE? 2. What are the reasons for the court not accepting the charge sheet? 3. Whom should I complain so that the police will re-submit the chargesheet as soon as possible.

The investigation in the present matter stands completed and the police have themselves stated that the chargesheet was prepared and forwarded to the Court; however, the same has not been properly filed till date. The explanation that the chargesheet was not accepted by the Court clearly indicates that there were defects or deficiencies, which the Investigating Officer was required to rectify promptly. The continued failure to re-submit the chargesheet for such a prolonged period reflects inaction and lack of diligence on the part of the police authorities. The law mandates that investigation and filing of the final report be carried out without unnecessary delay, and such prolonged pendency after completion of investigation is not justified. In these circumstances, it is advisable to approach the concerned Court and seek appropriate directions to the Investigating Officer to remove the defects and file the chargesheet at the earliest, so that the matter can proceed further in accordance with law.

your case, the issue relates to delay and improper filing of chargesheet under Code of Criminal Procedure, 1973. Road Certificate: Road Certificate ek internal police document hota hai jiske through case file/chargesheet ko police station se court tak physically bheja jata hai. Ye sirf dispatch proof hota hai, court filing ka conclusive proof nahi hota. Court ne chargesheet accept kyu nahi ki: Iske common reasons ho sakte hain: Incomplete documents ya annexures missing Sanction required but not filed Clerical defects / improper formatting Indexing ya pagination issues Investigation incomplete hona Aise cases me court objections laga kar chargesheet wapas bhej deta hai for compliance. Aap kya remedy le sakte hain: Concerned Magistrate Court me application file karke status report mangwa sakte hain Senior police officers jaise DCP/SP ko written complaint de sakte hain Aap Section 156(3) CrPC ke tahat direction bhi seek kar sakte hain for proper investigation and filing Agar delay excessive hai, to High Court me writ petition bhi file ki ja sakti hai for direction to police

ROAD CERTIFICATE: A Road Certificate is an internal police document used to show the movement/dispatch of case property or documents (like a chargesheet) from the police station to another authority, including the court. It is not proof of filing in court; actual filing is complete only when the court registry accepts it. Reasons for non-acceptance of chargesheet: A chargesheet may be refused by the court registry due to: Incomplete documents or missing annexures Lack of proper signatures or verification Non-compliance with procedural requirements Defects in formatting or indexing Missing sanction (if required) or FSL reports In such cases, the registry returns it for correction and re-filing. Place request before the adjudicating judge for expeditious filing of the chargesheet. Remind the judge about the delayed filing of the chargeaheet and and say that laste time police erred in filling the proper chargesheet.

1. A Road Certificate is an internal police document used to show that the charge sheet or case file was dispatched from the police station to the court or another authority. It is only proof of dispatch, not proof that the court has accepted or taken the charge sheet on record. 2. The court may refuse to accept a charge sheet due to procedural or legal defects, such as incomplete documents, missing annexures (like FSL report or sanction), improper filing, lack of jurisdiction, or non-compliance with legal requirements. In such cases, the police are required to rectify the defects and re-submit it. 3. File an application before the concerned Magistrate seeking status and direction to the police to re-submit the charge sheet without delay. • Approach senior police authorities (DCP/SP) with a written complaint regarding inaction. • If delay continues, you may  approach the High Court seeking directions for expeditious filing of the charge sheet. Since there has been a long delay, the court can direct the Investigating Officer to re-file the charge sheet within a specific time.
