Question about Bail - Murder Case

Hi, Researching for something. I wanted to know if someone who is prime suspect in a murder case, can he / she secure bail? Under what section of IPC would the suspect be charged and under what section would be if possible be secured? Thanks.

Well, A Prime Suspect can take Anticipatory Bail under Sec 438 (1) of CRPC before getting arrested. Prime Suspect can be arrested under the charges of Cognizable Offences which have been commited by him.

he will be charged under section 302 of Indian Penal Code and even for bail the nature of evidence involved in the case is very important. whether the case is based on direct or circumstantial evidence. the brutality in commision of alleged offence the upto some extent the antecedents of the accused.
