My HC advocate says FIR cannot be quashed or the HC will not accept the pet unless the trial court has issued order of cognisance. Is that true?
Hello,
FIR can be challenged to be quashed before the Hon'ble High Court, your Counsel might be saying this because there might not be sufficient materials in the FIR or contradictions which are a ground for challenge but you can also challenge the Charge Sheet.
