PS5 Rental Fraud – Cheating, Breach of Trust & FIR

11-Sep-2026 (In Criminal Law)
I run an unregistered PS5 rental business without formal rental agreements. A person rented 4 PS5s worth ~₹2.5 lakh. I have WhatsApp chats, payment/delivery records and his ID. He repeatedly gave suspicious/false explanations, failed to return them and later said they were sold. He was caught by us and taken to police while attempting to obtain a 5th PS5. Can this amount to cheating/criminal breach of trust? Can an FIR be registered despite voluntary rental, no registration/documents? what to do

Indeed, even in the absence of a rental agreement, a First Information Report (FIR) can be filed for fraud as long as the complaint reveals a cognizable offense—a serious felony that allows police to make an arrest without a warrant—like cheating, forgery, or criminal breach of trust. A civil paper is a leasing agreement. If a specific offense was committed, its absence does not exclude the application of criminal law. But the type of fraud is crucial.

Yes. An FIR can be sought even without a formal rental agreement or business registration, provided the facts disclose a cognizable offence. The absence of a written agreement is not by itself a defence for the person who took the PS5s. On your facts, there are two potentially important offences under the Bharatiya Nyaya Sanhita (BNS): Cheating — Section 318 BNS: the crucial question is whether he had dishonest intention when he obtained the PS5s. A later failure to return property, by itself, does not necessarily prove cheating; there must be material suggesting dishonest intention at the inception. Criminal breach of trust — Section 316 BNS: this can become relevant where property was entrusted to him and he subsequently dishonestly converts, uses or disposes of it contrary to the agreement/understanding. Your evidence is potentially quite strong: WhatsApp conversations, payment records, delivery records, identification details, the rental arrangement, requests for return, his subsequent statement that the PS5s were sold, and the circumstances in which he was found while attempting to obtain another PS5. The fact that he allegedly sold rented property is particularly important and should be specifically documented. What you should do now Do not rely merely on the fact that you caught him. Make a proper written complaint/FIR application setting out the chronology and annexing the documentary/electronic evidence. Preserve the original WhatsApp data, payment trail, serial numbers of all four PS5s, invoices/purchase records, delivery proof, and any CCTV or recording. Also, do not physically detain, threaten or assault him. If he was taken to the police station, allow the police to deal with him through lawful procedure. Your business being unregistered and the absence of a formal rental agreement do not automatically prevent criminal proceedings, although the prosecution will still have to establish the ingredients of the alleged offence. The rental transaction itself can be proved through surrounding electronic and documentary evidence. Given the value of approximately ₹2.5 lakh and the allegation that the consoles were sold, I would treat this as an urgent criminal complaint rather than merely a recovery dispute. The FIR should be drafted carefully so that the facts establish entrustment, dishonest conversion and/or dishonest inducement, rather than simply stating that the person failed to pay or return the consoles. If you have the WhatsApp conversation and the police complaint/FIR (if already registered), upload them and I can examine the exact wording and help structure the complaint and legal strategy.

Yes. If it can be shown that the person had a dishonest intention from the beginning, provided false explanations, failed to return the PS5s, and later admitted that they were sold, the facts may support allegations of Cheating and Criminal Breach of Trust. The absence of a registered business or a written rental agreement does not, by itself, prevent the registration of an FIR. WhatsApp chats, payment records, delivery proof, identity details, return-demand messages, and other digital evidence can be used to establish the transaction and subsequent misconduct. Based on the available evidence, the police can register an FIR, investigate the matter, and take appropriate legal action, including recovery of the property.
