Protection Against Suicide Of My Partner/Wife Who Has Suicidal Habit

28-Jun-2023 (In Criminal Law)
Hi All, My wife has suicidal tendencies and time & again I have managed to stop her. My question here is how do i seek protection against her actions as she has not been staying with me for 2 years approx. In my petitions & reply to her DV Complaint we have highlighted this along with evidence. Basically, my query is should she commit suicide tomorrow how can I prevent liability from coming over to me.

In order to hold you criminally liable for abetment of suicide there has to be an intent on your part in aiding or facilitating another person to end their life. Since, as per your submission here, you have demonstrated in your petition and reply in DV proceedings that the other person has suicidal tendencies and you have never intended or aided her ever to commit suicide, but have prevented her from committing suicide, this should work in your defence along with other grounds that you raise.

I have perused the contents of your query and would advise you to file an intallah peshbandi application with the concerned police authorities enunciating true facts. Further better particulars are required

You need to file a complaint against your partner or wife before the respective police station and further need to seek documentation from a doctor or something so as to show or prove that she is suffering from such mental problem and has suicidal tendency.
